Equipment Rental Agreement & Terms of Hire
Legally binding hire conditions under the Australian Consumer Law (Competition and Consumer Act 2010 Cth) and the Fair Trading Act 2010 (WA).
1. Parties and Definitions
“Owner” / “Specrent” means Specrent (ABN registered in Western Australia), its operators, employees, and authorized agents providing specialist automotive equipment rental in Perth, WA.
“Hirer” / “Customer” means the person, business, or workshop hiring equipment from Specrent as identified in the online booking confirmation or hire invoice.
“Equipment” means the specialist tool kit, precision alignment gauges, mandrels, pullers, cases, cables, and all associated components supplied on hire.
“Hire Period” means the duration commencing from the scheduled collection handover window until the agreed return handover window.
2. Collection, Return & Handover Windows in Perth
2.1 Collection: The Hirer must collect the Equipment at the designated Perth collection location during their confirmed handover window (standard hours: Monday–Friday 5:30 PM – 8:30 PM; Saturday–Sunday 8:00 AM – 7:00 PM).
2.2 Return: The Equipment must be returned to Specrent on or before the scheduled return date and time. An allowance of up to one (1) hour grace period is provided if the Hirer gives prior notice by telephone or SMS.
2.3 Unapproved Late Return: If the Equipment is not returned by the end of the scheduled return window without approved extension, the Hirer will be charged the standard daily rate for each 24-hour period or part thereof, plus an administrative late-recovery fee of $50.00 AUD.
2.4 Metro Delivery: Where flat-rate Perth Metro delivery has been selected, handover occurs at the Hirer’s nominated garage or workshop address.
3. Security Bond & Deductions
3.1 Bond Requirement: A refundable security bond (typically $200.00 to $500.00 AUD depending on tool kit replacement value) is held or pre-authorized via credit card at booking or collection.
3.2 Inspection: Within twenty-four (24) hours of return, Specrent conducts a component count and mechanical integrity inspection.
3.3 Full Refund: If all pins, mandrels, adapters, hardware, and protective cases are returned clean, complete, and undamaged, the bond is released immediately back to the original payment card.
3.4 Authorised Deductions: Specrent reserves the right to deduct from the security bond:
- The replacement cost of missing components, alignment pins, or hardware;
- Cost of professional cleaning if tools are returned coated in excessive engine sludge, metal shavings, or corrosive chemicals ($40.00 AUD cleaning fee);
- Applicable unapproved late hire fees.
4. Hirer’s Operational Obligations & Safety
4.1 Competency: The Hirer warrants that they possess the necessary mechanical competence and technical skills to operate specialty automotive tools safely without causing damage to the tools or the vehicle under repair.
4.2 Proper Use: Equipment must only be used for its intended automotive repair purpose in accordance with OEM service manual instructions. Impact wrenches (rattle guns) must NEVER be used on precision threaded pullers, camshaft locking pins, or lead screws unless explicitly specified.
4.3 Pre-Use Check: The Hirer must verify that the tool fits the specific engine or chassis code before applying hydraulic or mechanical force.
5. Damage, Loss & Damage Protection Waiver
5.1 Hirer’s Liability: Subject to Australian Consumer Law, the Hirer is liable for loss, destruction, or damage to Equipment during the Hire Period.
5.2 Damage Protection Waiver: Where the optional Damage Protection Waiver has been purchased ($15.00 AUD):
- Specrent waives claims against the Hirer for accidental mechanical stress, hairline pin fracture, or unintended tool wear occurring during normal use;
- Exclusions: The waiver does NOT cover total loss, theft, disappearance of loose pins/adapters, use of unauthorized impact guns, or intentional abuse.
6. Ownership & Title (PPSA)
The Equipment remains the sole and absolute property of Specrent at all times. The Hirer holds the Equipment solely as a bailee and has no right, title, or interest to sell, mortgage, pledge, or sub-hire the Equipment to any third party.
7. Limitation of Liability & Australian Consumer Law
7.1 Consumer Guarantees: Nothing in this Agreement excludes, restricts, or modifies any condition, warranty, or guarantee implied by the Competition and Consumer Act 2010 (Cth) or the Fair Trading Act 2010 (WA).
7.2 Consequential Loss: To the maximum extent permitted by law, Specrent is not liable for any indirect, consequential, or economic loss, including workshop downtime, lost revenue, engine reassembly delays, or vehicle damage resulting from the Hirer’s use or misuse of the Equipment.
8. Governing Law & Jurisdiction
This Agreement is governed by the laws of the State of Western Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia and the Commonwealth of Australia sitting in Perth, WA.
